The agreement, and who you are agreeing with

These terms are a contract between you and Selenthir Sp. z o.o., a limited liability company registered in Poland at Tysiąclecia 35 / 41, 41-303 Dąbrowa Górnicza (KRS 0001227518, NIP PL6292521423). Selenthir owns and operates Daiven. "We", "us" and "our" mean Selenthir; "you" means the person using Daiven.

By creating an account or using Daiven you accept these terms and the privacy policy. If you do not accept them, do not use Daiven.

Age and eligibility

Daiven is available only to people aged 18 or over. We do not offer the service to anyone below the age of majority, and you may not create an account, buy a subscription, or use Daiven on behalf of someone who is under 18.

If we have reason to believe an account belongs to a minor, we will close it and refund any unused portion of a subscription paid on it.

You also confirm that you are not barred from receiving our services under any sanctions or export control law that applies to you.

What Daiven is — and what it is not

Daiven is a personal AI system built around a group of agents. Every session begins with an intake agent, which works out what you actually need and routes you to a specialist — the Mirror, the Sentinel, the Judge, the Confidant, the Truth-Teller, the Witness, the Devil's Advocate, the Strategist. The agents draw on a profile of your values, patterns and past decisions to answer you specifically rather than generically.

Daiven is not a medical device, a therapy service, a legal or financial adviser, or a crisis service. It does not provide professional advice of any kind, and no agent is a licensed professional. If you are in crisis or at risk of harming yourself or anyone else, contact your local emergency services or a crisis line — not Daiven.

Your account

  • Give us an accurate email address and keep it current. It is how we reach you about your subscription, your data, and anything going wrong with your account.
  • One account per person. Accounts are personal to you, and you may not share your login, sell access, or let anyone else use your account.
  • You are responsible for keeping your password safe. We strongly recommend turning on two-factor authentication in Settings.
  • Tell us promptly at legal@daiven.app if you think someone else has got into your account.

The free trial

The trial is seven days and 1,200 credits, with no card required.

  • It does not convert into a paid plan. When it ends, nothing is charged; you choose a plan or you don't.
  • It gives you the full onboarding and a subset of the agents.
  • One trial per person. To enforce that without keeping your email address on file after you leave, we store a one-way hash of the address a trial was granted to. Creating a second account to take a second trial is a breach of these terms.
  • Profile data built during a trial is kept for 14 days after the trial ends, and then deleted. We email you seven days before that happens.

What a credit is. A credit is a unit of an agent's time and resources. Each agent has its own rate, and the rate steps up as a session gets longer, because a longer session costs more to run. The cost of your next message and your remaining balance are shown in the chat before you send it, so you are never spending blind.

Attachments and web search cost extra. Each image you attach to a message adds 6 credits to the cost of that message — attach three images and that is 18 credits on top of the agent's rate. Each web search an agent runs adds 10 credits. Both are included in the cost shown to you before you send. Attaching a text file costs nothing extra.

The intake agent is free. Working out which agent you need never costs anything — including any images you attach while doing it. The 6-credit image charge applies only to the specialist agents.

Running out mid-session. The session stops where it is and the conversation stays exactly as it was. You can top up or wait for your next monthly grant. An agent will never quietly shorten an answer to fit the credits you have left.

Two kinds of credits. Your monthly allowance is granted at the start of each billing period and is use it or lose it — whatever is left is reset to the new month's allowance at renewal rather than added to it. Credits you buy as a top-up never expire and are never reset. When you spend, your monthly allowance is used first, so the credits that can expire are the ones that get used.

Credits are not money. They have no cash value, cannot be transferred between accounts, and cannot be exchanged for cash except where these terms or the law require a refund.

If your subscription ends, the credits in your account are frozen rather than deleted: they stay on the account and become spendable again if you resubscribe, subject to the data retention rules below.

Price, tax and payment

  • Prices are in US dollars and are exclusive of tax. VAT, GST or sales tax is calculated at checkout according to where you are and added to the price shown here. The total you will be charged is always shown before you confirm.
  • Payment is taken by Stripe. We never see or store your card details. By paying you also accept Stripe's terms.
  • Subscriptions are billed in advance, monthly or yearly, and renew automatically until you cancel.
  • Top-ups are one-off purchases, charged when you make them.
  • If we change the price of your plan, we will tell you at least 30 days before it takes effect, and it will never apply to a period you have already paid for. You are free to cancel before the new price applies.

Renewing, upgrading and downgrading

Renewal. Your plan renews automatically at the end of each billing period at the price then in effect, using the payment method on file, until you cancel.

Upgrades take effect immediately. You get the new plan's agents, features and credit allowance at once, we charge the difference on a pro-rata basis, and a fresh billing period starts on the day you upgrade.

Downgrades take effect at your next billing date. You keep everything you have already paid for until then, including the credits already granted for the current period.

Cancelling

You can cancel at any time from your account page. There is no cancellation fee and no notice period.

  • Monthly plans. You keep access until the end of the period you have paid for, and are not charged again.
  • Yearly plans. You keep access until the end of the period, and we refund the unused whole months of your subscription.

Refunds, and our 14-day money-back guarantee

If you change your mind within 14 days of a payment, email support@daiven.app and we will refund it. You do not have to give a reason. This applies to your first subscription payment and to top-up purchases.

Two limits worth stating plainly:

  • Credits you have already spent are not refunded — that work has been done and paid for on our side.
  • The guarantee covers a payment you are having second thoughts about, not repeated buy-and-refund cycles on the same account.

Withdrawing your consent to sensitive-data processing. You can withdraw that consent at any time in Settings, and doing so ends your use of Daiven — the privacy policy explains why there is no version of the service that runs without it. We treat that as a cancellation and nothing worse: the cancellation terms above apply unchanged, including the refund of unused whole months on a yearly plan, and credits you have bought stay on the account rather than being forfeited.

Withdrawing that consent does not, by itself, create a refund, and it does not extend or restart the 14-day guarantee. If you are still inside that window — or inside a statutory withdrawal period — you can use it on its own terms, exactly as you could had you not withdrawn your consent.

We set this out plainly because the choice is an informed one. We ask for that consent separately when you sign up and explain what it is for; we ask again before anything is written to your profile; every section of that profile can be changed by simply telling an agent to change it; and you can erase the whole profile and start over at any time without withdrawing anything.

If you are a consumer in the EU, the EEA or the UK, you also have a statutory right to withdraw from this contract, which is a different thing from withdrawing the consent described above. This guarantee sits on top of those rights and never replaces them, and nothing in these terms takes away a right the law gives you that cannot be waived.

Refunds go back to the card you paid with, through Stripe, and typically appear within five to ten working days depending on your bank.

If a payment fails

If a renewal payment fails, your access continues for three days while your bank retries. We will email you. If it has not been paid by the end of that grace period, the subscription lapses: your credits are frozen and plan-only features stop working, but your data is not deleted straight away — see the next section.

What happens to your data when a subscription ends

Your profile — values, patterns, memories, decisions — is kept for a period that depends on the plan you were last on:

We email you seven days before anything is deleted. Deletion is permanent. Export your data first if you want to keep it — the export is a single file containing your whole profile, and it is available on every paid plan.

Acceptable use

Do not:

  • Use Daiven for anything unlawful, or to plan, encourage or carry out harm to yourself or anyone else.
  • Try to break, probe or circumvent our security, rate limits, credit accounting or plan restrictions.
  • Use automated means to access the service, scrape it, or resell access to it.
  • Impersonate anyone, or upload another person's private information where you have no proper basis for doing so.
  • Attempt to make an agent produce material that is illegal, or that breaks the usage policies of the AI providers whose models generate the replies. Those policies apply to your input, because your input reaches them.
  • Reverse-engineer, copy or redistribute the agents, their instructions, or the rest of the service.

Separately from the above, some kinds of information are never stored in your profile, whatever you ask. Daiven will discuss them with you and decline to write them down — see what we will not record. This is not a restriction on you and nothing happens to your account because of it; the entry is simply not kept.

We screen input and output automatically for these things, and a session may be blocked or an account suspended as a result. If that happens to you in error, write to legal@daiven.app and a person will look at it.

What you write, and what we own

Your content stays yours. Everything you tell an agent, upload, or build up in your profile belongs to you. You give us only the licence we need to run the service for you: to store it, process it, and send it to the AI provider that generates your reply. That licence ends when you delete the content or your account.

We do not train models on your content, and neither do our AI providers. We use their APIs on commercial terms that exclude your content from model training. The privacy policy sets out exactly what is sent, to whom, and how long they keep it.

Custom agents. If your plan lets you create your own agent, the instructions you write are your content, and you are responsible for them — including for keeping them within the acceptable use rules above.

What we own. Daiven itself — the software, the agent designs and their instructions, the site, the name and the branding — belongs to us. Nothing in these terms transfers any of it to you.

An agent's replies are yours to use. Use them personally and commercially as you see fit. Bear in mind that AI output is not always original or unique, and that we cannot promise it does not resemble something generated for someone else.

What an agent's answer is worth

Read this part properly; it is the most important thing in this document.

Daiven's agents produce opinions, arguments, challenges and analysis. They are generated by large language models, and:

  • They can be wrong. Models state incorrect things confidently. An agent can misread your situation, misremember your profile, or reason badly.
  • They are not professional advice. Nothing an agent says is medical, psychological, legal, financial, or tax advice, and no reliance you place on it creates a professional relationship.
  • They do not decide anything. Every decision remains yours. An agent's job is to sharpen your judgement, not to replace it. We make no automated decision that has a legal effect on you.
  • They are not a crisis service. If you are in danger, contact emergency services.

You are responsible for what you do with what an agent tells you. Where the law allows us to say so, we accept no liability for decisions you take on the strength of an agent's output.

Availability and changes to the service

We work to keep Daiven available, but we do not guarantee uninterrupted service and offer no uptime commitment. Maintenance, faults, and the outages of the providers we depend on all happen. We will give notice of planned downtime where we reasonably can.

Daiven is in active development and features will change. We may add, alter or remove them. If a change materially and adversely affects what you are paying for, we will give you at least 14 days' notice and you may cancel and take a refund of the unused part of your subscription. Minor changes, fixes and improvements happen without notice.

Suspending or closing an account

We may suspend or close an account that breaches these terms, that is being used unlawfully, or where we are required to by law. Except where the breach is serious or we cannot lawfully give notice, we will warn you first and give you a chance to put it right.

If we close a paid account for reasons that are not your fault, we refund the unused part of your subscription. If we close it for a serious breach, we do not.

You can close your own account at any time from Settings.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for intentional harm or gross negligence, or for anything else that cannot be limited under Polish or EU law. If you are a consumer, your mandatory statutory rights are unaffected by anything in this section.

Subject to that:

  • Daiven is provided as is. Beyond what the law requires of us, we give no warranty that it will be error-free, uninterrupted, or fit for a particular purpose.
  • We are not liable for indirect or consequential loss, lost profits, lost opportunity, or loss arising from decisions you made on the strength of an agent's output.
  • Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the event giving rise to it.

Changes to these terms

We may update these terms. If a change is material, we will tell you at least 14 days before it takes effect, by email or in the app.

If you do not accept a change, you may cancel before it takes effect and we will refund the unused part of your subscription. Continuing to use Daiven after that date means you accept the new terms.

Law, and where disputes go

These terms are governed by Polish law.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country. You can also get free help from a local consumer ombudsman (powiatowy lub miejski rzecznik konsumentów in Poland), from the Trade Inspection Authority, or from the Office of Competition and Consumer Protection at uokik.gov.pl. A list of alternative dispute resolution bodies across the EU is published by the European Commission.

If you are not a consumer, disputes go to the courts having jurisdiction over our registered office.

Before any of that, please write to us. Most things are resolved by email in a day.
